By using the ‘ATPHIZYOM’ Products’ and/or Services’ platforms, you consent to the data practices described in this statement. Your home jurisdiction may have privacy laws and guidelines that are more or less protective than the guidelines herein. This Policy applies only to the information that you provide to us through the ‘ATPHIZYOM’ Products’ and Services’ platforms.

IMPORTANT: This Privacy Policy Statement outlines the use of all identifying personal information submitted and collected on ‘ATPHIZYOM’s’ Mobile Application (hereby, the “Mobile App”), ‘ATPHIZYOM’s’ Web Application (hereby, the “Web App”), ‘ATPHIZYOM’s’ Website (hereby, the “Website”), hereafter collectively the ‘ATPHIZYOM’ Products (hereby, the “Products”), and ‘ATPHIZYOM’ Services (hereby, the “Services”) platforms. This privacy notice does not encompass other websites or third-party links referenced to or by ‘ATPHIZYOM’ in any way, including but not limited to print, online, or in e-mail. ‘ATPHIZYOM’, its affiliates, clients and all of their respective authorized representatives, officers, directors, employees, agents, shareholders, licensors, attorneys, successors, and assigns (“ATPHIZYOM”), is firmly committed to protecting personal and financial information. This Privacy Policy statement embodies our commitment to its protection through adherence to fair electronic information practices.
ACKNOWLEDGEMENT & ACCEPTANCE OF TERMS
‘ATPHIZYOM’ is committed to protecting its Users’ privacy. This Privacy Policy Statement sets forth our current privacy practices with regard to the information we collect when you or your computer or mobile device interact with our Mobile App, Web App and/or Website (the “Products”) and/or Services (the “Services”). By accessing our Products and/or Services, you acknowledge and fully understand the Privacy Statement and freely consent to the information collection and use practices described in ‘ATPHIZYOM’s’ Privacy Policy Statement.
INFORMATION WE COLLECT & HOW WE USE IT
When you use or connect to our Products and/or Services through your computer or a mobile device, the owners and publishers of the Products and/or Services collect certain information from and about its Users in a few ways, directly from our web server logs, from you, with the aid of cookies, with web beacons, and through the use of website analytics through third-party service providers. We may collect personally identifiable information necessary for internal marketing purposes based on User activity, registration and billing from customers who purchase and subscribe to our ‘ATPHIZYOM’ Products (the “Products”) and ‘ATPHIZYOM’ Services (the “Services”) online, hereafter collectively the ‘ATPHIZYOM’ Products & Services (hereby, the “Products & Services”).
‘ATPHIZYOM’s’ proxy is a gateway for the User’s network, and is set for the purposes of retrieving such information, and basing marketing material on it. We do not collect any sensitive information.
Visitors and Users of our Products and/or Services can register to create an ‘ATPHIZYOM’ User Account (hereafter, the “User Account” or “Account”), access the Products and/or Services, download Software (Mobile App / Web App), and possibly purchase Products and/or Services. When you register, we will request some personal information such as your name, address, e-mail, telephone number or facsimile number, location, account number and other relevant information. We also collect your IP computer address. If you are purchasing Products and/or Services, we will request financial information. Any financial information we collect is used only to bill you for the Products and/or Services you purchased. If you purchase by credit card, this information may be forwarded to your credit card provider. For other types of registrations, we will ask for the relevant information. You may also be asked to disclose personal information to us so that we can provide assistance and information to you. For example, such data may be warranted in order to provide online technical support and troubleshooting.
‘ATPHIZYOM’ may collect anonymous demographic information, which is not unique to you. We may gather additional information or non-personal information. ‘ATPHIZYOM’ may collect navigational information, including information about the pages and applications you view and/or use, the links you click, and other actions taken in connection with the Products’ and/or Services’ platforms. Information about your computer and/or mobile device hardware and software may be automatically collected by ‘ATPHIZYOM’. Additionally, we may gather information regarding your use of the ‘ATPHIZYOM’ Products’ and/or Services’ applications and referral services. This information can include: your IP address, browser type, domain names, location and/or GPS coordinates (if these features are enabled), smart phone or tablet or mobile device identifiers (not including UDID), MAC address, wireless service provider, operating system, access times and referring website addresses. This information is used for the operation of the Products and/or Services provided by ‘ATPHIZYOM’, to maintain quality of the Products and/or Services, and to provide general statistics regarding use of the ‘ATPHIZYOM’ Products and/or Services. This information is used only to analyze trends, administer the Products and/or Services, track User movements and gather broad demographic information for internal use. Most importantly, any recorded IP addresses are not linked to identifiable information of any User.
‘ATPHIZYOM’ only collects personally identifiable information about you after you have provided ‘ATPHIZYOM’ with your consent to collect that specific information. Personal information may include, but is not limited to, information collected when you register or visit the Products’ and/or Services’ platforms including, but not necessarily limited to: your Account ID or User Name (hereafter, the “User Name”) and Password (hereafter, thes “Password”), your name, your mailing address, e-mail address, IP address and phone number, and information collected when you make a purchase including your credit card number and billing address, or any information you may provide to allow ‘ATPHIZYOM’ to make payments to you. ‘ATPHIZYOM’ encourages you to review the privacy statements of websites and/or applications you choose to link to from ‘ATPHIZYOM’s’ Products’ and/or Services’ platforms so that you can understand how those websites and/or applications collect, use and share your information. ‘ATPHIZYOM’ is not responsible for the privacy statements or other content on websites and/or applications outside of the ‘ATPHIZYOM’ Products’ and Services’ platforms. You may choose not to provide certain personal information to ‘ATPHIZYOM’, but in doing so, certain products and/or services may not be available to you.
‘ATPHIZYOM’ collects and uses your personal information to operate its Products’ and/or Services’ platforms and deliver the products and/or services you have requested. Uses may include, but are not limited to: creation and management of your User Account, processing of any transactions (including transaction-related communications) or providing customer support. ‘ATPHIZYOM’ may disclose your personal information to third-party service providers who perform services on ‘ATPHIZYOM’s’ behalf.
‘ATPHIZYOM’ may also use your personally identifiable information to inform you via newsletters, marketing or promotional materials or other means of other products or services available from ‘ATPHIZYOM’ and its affiliates. ‘ATPHIZYOM’ may also contact you via surveys to conduct research about your opinion of current products and/or services or of potential new products and/or services that may be offered or to perform research and analysis directed towards improving ‘ATPHIZYOM’ products and/or services. ‘ATPHIZYOM’ does not sell, rent or lease its customer lists to third parties.
‘ATPHIZYOM’ may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is transferred to a third party. ‘ATPHIZYOM’ may share data with trusted partners to help perform statistical analysis, send you e-mail or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to ‘ATPHIZYOM’, and they are required to maintain the confidentiality of your information.
‘ATPHIZYOM’ may keep track of the websites, pages and applications our Users visit and/or use within the ‘ATPHIZYOM’ Products’ and/or Services’ platforms, in order to determine what ‘ATPHIZYOM’ Products and/or Services are the most popular. This data may be used to deliver customized content and advertising within ‘ATPHIZYOM’ to customers and/or Users whose behavior indicates they are interested in a particular subject area.
Information about ‘ATPHIZYOM’ customers and Users, including personal information, may be disclosed as part of any merger, acquisition, or sale of the ‘ATPHIZYOM’ related Company (hereby, “ATPHIZYOM, LTD.” or “Us”) and/or assets, as well as in the unlikely event of insolvency, bankruptcy, or receivership, in which personal information would be transferred as one of the business assets of the Company. ‘ATPHIZYOM’ will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on ‘ATPHIZYOM’ or the Products’ and/or Services’ platforms; (b) protect and defend the rights or property of ‘ATPHIZYOM’; and, (c) act under exigent circumstances to protect the personal safety of Users of the ‘ATPHIZYOM’ Products’ and/or Services’ platforms, or the public.
WEB SERVER LOGS
When you visit and use our Products and/or Services, we may track information through web server logs to better administer the Products and/or Services and analyze their usage. Examples of information we may track include, but is not limited, to your Internet Protocol address (“IP”), the type of browser or computer or mobile device you use, the number of links you click within the Products’ and/or Services’ platforms, the geographical location from which you accessed the Products and/or Services, the date and time of your visit and usage, the name of your Internet service provider, any web pages or third-party applications you linked to our Products and/or Services from, and web pages or third-party applications you viewed on the Products’ and/or Services’ platforms.
When you visit our Products’ and/or Services’ platforms, whether as an ‘ATPHIZYOM’ Member (hereby, a “Paid Subscriber”), registered User or a non-registered User just browsing (any of these, a “User”), our servers automatically record information that your browser sends whenever you visit or use a website or application (“Log Data”). This Log Data may include information such as your computer’s and/or mobile device’s Internet Protocol (“IP”) address, browser type or the webpage or application you were visiting or using before you came to our Products’ and/or Services’ platforms, pages or applications or portions of our ‘ATPHIZYOM’ Products’ and/or Services’ platforms that you visit or click on, the time spent on those pages or applications, information you search for on the ‘ATPHIZYOM’ Products’ and/or Services’ platforms, access times and dates, and other statistics. We use this information to monitor and analyze use of the ‘ATPHIZYOM’ Products and/or Services and for the ‘ATPHIZYOM’ Products and/or Services platforms’ technical administration, to increase the ‘ATPHIZYOM’ Products and/or Services platforms’ functionality and user-friendliness, and to better tailor them to our visitors’ and Users’ needs. For example, some of this information is collected so that when you visit the ‘ATPHIZYOM’ Products’ and/or Services’ platforms again, they will recognize you and serve advertisements and other information appropriate to your interests. We also use this information to verify that visitors to ‘ATPHIZYOM’ Products’ and/or Services’ platforms meet the criteria required to process their requests. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated below regarding other Non-Identifying Information under the section titled “Notice on Sharing & Disclosure of User Personal Information”.
USE OF COOKIES
‘ATPHIZYOM’ may use “cookies” to personalize or enhance your User experience. A “cookie” is a small text file that is placed on your hard disk or mobile device storage by a Web Page Server or Application to identify that specific user the next time he/she visits and uses the website or application. It is a small piece of information sent by a Web Server to a Web Browser, which enables the Server to collect information, including personal information, from the Browser. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a Web Server or Application in the domain that issued the cookie to you.
One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you personalize a web page or application settings, or navigate within a website or application, a cookie helps the website/application to recall your specific information on subsequent visits and usages. Hence, this simplifies the process of delivering relevant content and eases website/application navigation by providing and saving your preferences and login information as well as providing personalized functionality.
‘ATPHIZYOM’ may use cookies to enable you to sign in to the ‘ATPHIZYOM’ Products’ and/or Services’ platforms and to help personalize and improve your online experience. Cookies allow ‘ATPHIZYOM’ to identify registered Users when they return to the ‘ATPHIZYOM’ Products’ and/or Services’ platforms so that they can retrieve previous image results, shopping carts and invoices, among other useful information. Cookies save you time by eliminating the need to repeatedly enter the same information and by saving your preferences when using the ‘ATPHIZYOM’ Products’ and/or Services’ platforms, while allowing ‘ATPHIZYOM’ to deliver personalized information to you. Cookies can also help prevent fraud and protect your security by checking your login details.
Most browsers automatically accept cookies, but they also allow you to turn off cookies by modifying your browser settings. If you decline cookies, you may not be able to sign in or use other interactive features of our Products’ and/or Services’ platforms that depend on cookies but you will be able perform basic navigation of the ‘ATPHIZYOM’ Products’ and/or Services’ platforms.
We do not allow other companies on our Products’ and/or Services’ platforms to place cookies, unless there is a temporary overriding of a part in the Products and/or Services (such as integrating another website/application that relies on third-party cookies, into the existing Products and/or Services).
MODIFYING COOKIE SETTINGS
You have the ability to accept or decline cookies. Most Web Browsers or Applications automatically accept cookies, but you can usually modify your browser settings to delete or decline cookies. If you reject cookies by changing your browser/application settings then be aware that this may disable some of the functionality in our Products and/or Services.
USE OF WEB BEACONS OR “GIF” FILES
Our Products’ and/or Services’ platforms may contain electronic images known as “Web Beacons” (also called single-pixel GIFs) that allow the owners and publishers of the Products and/or Services to count Users who have visited or used those web pages or applications and to deliver certain products and/or services. The owners and publishers of the Products and/or Services may include Web Beacons in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon.
Some Web Beacons may be placed by third-party service providers to help us determine the effectiveness of our Products and/or Services, advertising campaigns or e-mail communications. These Web Beacons may be used by these service providers to place a persistent cookie on your computer or mobile device, for the benefit of ‘ATPHIZYOM’. This allows the service provider to recognize your computer or mobile device each time you visit or use certain web pages, applications or e-mails and compiles anonymous information in relation to those page/application views or use, which in turn enables us and our service providers to learn which advertisements, e-mails and third-party applications bring you to our Products’ and/or Services’ platforms and how you use the Products and/or Services. ‘ATPHIZYOM’s’ Web Beacons are not used to collect or access your identifying personal information.
NOTICE ON SHARING & DISCLOSURE OF USER PERSONAL INFORMATION
‘ATPHIZYOM’ reserves the right to share aggregated Products & Services statistics with partner companies, sites and affiliates, including brokers, to help enhance its product and service offerings, but does not sell or forward identifying personal information to third-party companies. Personal User information collected by or submitted to ‘ATPHIZYOM’ shall not be disclosed to any third parties without your permission, unless such information: (i) is used to fulfill your service requests; (ii) is required to be disclosed by law, regulation, legal process, law enforcement or government regulatory authorities, in which case we shall give you as much advance notice as is reasonably practicable in order to allow you to limit or restrict to such disclosure; or (iii) is required to be disclosed in order for us to protect our legal rights or defend against liability; or (iv) is used in connection with a merger, acquisition, or liquidation of ‘ATPHIZYOM’.
‘ATPHIZYOM’ Members / Users – When you register and create a User Account on the ‘ATPHIZYOM’ Products’ and/or Services’ platforms and submit your personally identifying information (hereafter, “Personal Information”) to create an Account Profile (hereafter, the “Account Profile” or “Profile”), ‘ATPHIZYOM’ Members (hereby, “Paid Subscribers”) and Users of certain third-party websites and/or applications will see your “Screen Name” (“Required Member Identifiers”). You can choose what other Personal Information or other information to provide as part of your Profile (“Other Member/User Information”). Providing Other Member/User Information is voluntary and should correlate with the degree of interaction you want to have with ‘ATPHIZYOM’ Members and Users. We recommend that you guard your anonymity and sensitive information and that you not use your real name as your “Screen Name,” since that would allow others to identify you. You can review and revise your Profile information at any time.
Aggregate Information & Non-Identifying Information – We may share aggregated information that includes your Non-Identifying Information and Log Data with third parties for industry analysis and demographic profiling and to deliver targeted advertising about other products and/or services.
Service Providers – We may employ third party companies and individuals to facilitate our Products and/or Services, to provide the Products and/or Services on our behalf, to perform ‘ATPHIZYOM’ Products’ and/or Services’ platform related services (e.g., without limitation, maintenance services, database management, web analytics and improvement of the Products’ and/or Services’ platform features) or to assist us in analyzing how our Products and/or Services are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. We may also provide Personal Information to our business partners or other trusted entities for the purpose of providing you with information on products and/or services we believe will be of interest to you. You can, at any time, opt out of receiving such communications. These third party companies will be bound by a non-disclosure agreement and fiduciary duties which will prohibit any soliciting or use of ‘ATPHIZYOM’ Members’ and Users’ information.
Compliance With Laws & Law Enforcement – ‘ATPHIZYOM’ cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal processes (including but not limited to subpoenas), to protect the property and rights of ‘ATPHIZYOM’ or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, any illegal, unethical, offensive or legally actionable activity.
SECURITY OF YOUR PERSONAL INFORMATION
‘ATPHIZYOM’ secures your personal information from unauthorized access, use or disclosure. ‘ATPHIZYOM’ takes appropriate and conceivable safeguards to ensure the protection of its Users’ personal information from misuse, unauthorized access, disclosure, alteration, loss and destruction. Users should note that no security measure is perfect or can be fully guaranteed. Any data transmission cannot be fully guaranteed against any misuse by third parties, but ‘ATPHIZYOM’ will do all it can to try to keep its Users’ data safe.
PHISHING
Identifying theft and the practice currently known as “Phishing” are of great concern to ‘ATPHIZYOM’. Safeguarding information to help protect you from identity theft is our top priority. We do not and will not, at any time, request your credit card information, your Account ID or User Name, login Password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. CHILDREN UNDER EIGHTEEN
‘ATPHIZYOM’ does not knowingly collect personally identifiable information from children under the age of eighteen (18). If you are under the age of eighteen (18), you must ask your parent or guardian for permission to use our Products’ and/or Services’ platforms. By using our Products’ and/or Services’ platforms you represent and warrant that you either are eighteen (18) or older or have received your parent’s or guardian’s permission to use our Products’ and/or Services’ platforms.
INTERACTIVE SERVICES
The ‘ATPHIZYOM’ Products’ and/or Services’ platforms may include interactive areas or services, including (but not limited to) blogs, chat rooms, bulletin boards, message boards, online hosting or storage services, or other areas or products or services in which you or third parties create, post or store any content, messages, comments, materials or other items on the Products’ and/or Services’ platforms (“Interactive Areas”). If you use an Interactive Area, you should be aware that these areas are open to the public and any personal information you post or provide at registration or at any time may be viewable by others. ‘ATPHIZYOM’ is not responsible for personal information you submit in connection with the Interactive Areas, nor is ‘ATPHIZYOM’ responsible for how others might use that information, including sending you unsolicited messages. Interactive Area postings may be retained indefinitely. If at any time you would like to remove a posting in the Interactive Areas on our Products’ and/or Services’ platforms, please contact ‘ATPHIZYOM’. Removal of a posting from an Interactive Area does not mean that the posting will be deleted from the ‘ATPHIZYOM’ systems.
LINKS TO THIRD-PARTY SITES, APPLICATIONS, PRODUCTS & SERVICES
The ‘ATPHIZYOM’ Products’ and/or Services’ platforms may contain links to third-party websites, applications, products and/or services. ‘ATPHIZYOM’ is not responsible for the privacy practices or the content of those third-party websites, applications, products and/or services. When you visit linked sites, applications, products and/or services, those sites, applications, products and/or services may collect information from you directly, in which case the third-party privacy policy (which may differ from the ‘ATPHIZYOM’ Privacy Policy) would apply. As a Member or User of our Products’ and/or Services’ platforms, you will have the option of granting ‘ATPHIZYOM’ access to your account(s) with certain third-party social media and networking sites (each, an “SNS”). By granting ‘ATPHIZYOM’ access to your SNS account(s), you understand that ‘ATPHIZYOM’ will access, render and store content from your SNS account(s), including Personal Information about you, so that it is available and viewable through the ‘ATPHIZYOM’ Products’ and/or Services’ platforms. We encourage you to read the privacy policies or statements of the other third-party online services you use. You have the ability to disable the connection between our Products’ and/or Services’ platforms and an SNS, at any time, via the “Settings” section of the individual Products’ and/or Services’ platforms.
OPT-OUT & UNSUBSCRIBE
If you wish, you may choose not to receive emails, newsletters and/or other communications from ‘ATPHIZYOM’ by clicking the “Unsubscribe” link in the email communication sent to your e-mail account registered with our Products’ and/or Services’ platforms.
All ‘ATPHIZYOM’ Members and Users may review, update, correct or delete the Personal Information in their registration Profile by visiting the Products’ and/or Services’ platforms. You can deactivate and delete your account by following the prescribed method listed on our Products’ and/or Services’ platforms. If you delete your account record in our system, this will delete your Personal Information from our database and cannot be undone. We may retain an archived copy of your records as required by law or for legitimate business purposes.
ACCESSING & CHANGING PERSONAL INFORMATION
You can ensure that your identifying personal information in your web or application Account Profile is correct and up to date by contacting our support attendants via the support desk on our ‘ATPHIZYOM’ Products’ and/or Services’ platforms.
INTERNET-BASED DATA & INTERNATIONAL TRANSFER
Given that the Internet is a global environment, using the Internet to collect and process personal data necessarily involves the transmission of data on an international basis. Therefore, by browsing or using our Products and/or Services and communicating electronically with us, you acknowledge and agree to our processing of personal data in this manner.
Your information may be transferred to – and maintained on – computers located outside of your city, state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside of the Hong Kong Special Administrative Region (SAR) and choose to provide information to Us, ‘ATPHIZYOM’ transfers Personal Information to the Hong Kong Special Administrative Region (SAR) and/or elsewhere and processes it there.
